Every home care patient in NJ has a specific set of rights — some rooted in NJ law, some in HIPAA, some just in the industry standard of what good care looks like. Most families never see the full list at intake. So when a right is quietly walked around, no one flags it. This article walks through the three rights that most often go missing on the ground, from a decade of watching.

Missed right #1 — The written care plan you can actually read

New Jersey home care patients are entitled to a written, individualized care plan before service starts — signed by the patient or their authorized representative, in a language they read fluently. In practice, many families receive a service agreement (a billing document) and are told that IS the care plan. It is not. If you have signed something at intake and never seen a document that lists what the caregiver will and won’t do — including bathing, meds, meals, transfers, and hours — that is a missed right. Ask for the care plan in writing today.

Missed right #2 — The RN oversight nobody visits about
