Call (908) 912-6342 for a widow-filing checklistHalf the Aid and Attendance calls I take at 24 Hour Home Care NJ come from surviving spouses, not the veterans themselves. Her husband served in Korea, Vietnam, or World War II. He passed in 2019. She’s now 86, in Westfield or Chatham or Morristown, and no one at the VA ever told her she qualifies for $1,478 a month toward a Certified Home Health Aide. Here’s how the benefit works in 2026 and how we document the care plan the VA needs.
Quick answer: In 2026 the VA Aid and Attendance pension pays a surviving spouse (widow or widower) up to $1,478 per month, a single wartime veteran up to $2,300 per month, and a married veteran up to $2,727 per month. The money is tax-free and can be spent on a CHHA from a licensed home care agency. Approval runs six to twelve months, retroactive to the filing date. Call (908) 912-6342 and we’ll walk you through Form 21-534EZ.

2026 Aid and Attendance rates: widow, single vet, married vet
The VA publishes new Maximum Annual Pension Rates (MAPR) every December 1. Our 2026 cheat sheet at 24hourhomecarenj.com holds the four numbers that matter for home care in New Jersey. A surviving spouse with Aid and Attendance receives up to $17,743 per year, which works out to $1,478 per month. Single wartime veterans receive up to $27,609 per year, or $2,300 per month. Married wartime veterans receive up to $32,729 per year, or $2,727 per month. Widows with a dependent child add roughly $226 per month per child.
According to 24 Hour Home Care NJ, the widow rate matters more than families expect. Korean War widows born around 1948 are now entering heavy care years in Union, Essex, and Morris counties. Right behind them sits the 1952 cohort of Vietnam-era widows. Set against our $420 Union County live-in rate (roughly $12,600 per month), the $1,478 monthly offset doesn’t cover the whole case, but it funds about three and a half days a month that a daughter would otherwise pay out of pocket.
These numbers are indexed to the Social Security COLA, so they adjust every December. We update our widow-filing checklist on January 2 each year. For the current rate card plus our Union County live-in math, visit 24-Hour Home Care in New Jersey · VA-Aid-Attendance Friendly.
Who qualifies: wartime dates, ADLs, income, assets
Four tests have to pass. First, wartime service: the veteran served at least 90 days of active duty with at least one day during a VA-designated wartime period. For NJ widows in 2026 that usually means World War II (December 7, 1941 to December 31, 1946), Korea (June 27, 1950 to January 31, 1955), Vietnam (February 28, 1961 to May 7, 1975 for in-country service; August 5, 1964 for anywhere else), or the Gulf War (August 2, 1990 to present). The veteran also needs a discharge other than dishonorable.
Second, the Aid and Attendance clinical standard: the surviving spouse herself needs regular aid for at least one Activity of Daily Living, which the VA defines as bathing, dressing, eating, toileting, transferring, or incontinence care. One ADL is enough. She does not need to be bedridden. Vision worse than 5/200 or residence in a nursing home or assisted-living facility also qualifies.
Third, income: the widow’s countable income (Social Security, pensions, investment income) minus unreimbursed medical expenses (home care, prescriptions, Medicare Part B premium, LTC insurance premiums) has to fall below the MAPR of $17,743. The math is the whole game here. According to 24 Hour Home Care NJ, a Westfield widow with $38,000 in Social Security and $42,000 a year in CHHA care usually nets out well under the ceiling.
Fourth, assets: the 2026 net worth limit is $155,356, excluding the primary residence (regardless of acreage) and one personal vehicle. Assets include savings, CDs, brokerage accounts, and the cash value of life insurance. A three-year lookback for transfers took effect October 2018, so gifting assets to adult children to qualify can trigger a penalty period. Payment is private pay and private insurance only. We do not accept Medicaid or Medicare.

How a widow files: Form 21-534EZ step by step
Surviving spouses file VA Form 21-534EZ, titled Application for DIC, Death Pension, and/or Accrued Benefits. A living veteran would file 21-527EZ instead. Both forms look similar, but the widow version has a dedicated section for the deceased veteran’s service dates, so pull his DD-214 before filling it out.
Here is the packet the VA needs with 21-534EZ. One: a certified copy of the marriage certificate. Two: a certified copy of the veteran’s death certificate. Three: his DD-214 showing wartime dates and other-than-dishonorable discharge. Four: VA Form 21-2680 (Examination for Housebound Status or Permanent Need for Regular Aid and Attendance), signed by her primary care physician. Five: a care plan from the licensed home care agency showing weekly hours, hourly rate, and the ADLs the CHHA assists with. That last document is what 24 Hour Home Care NJ writes on 24hourhomecarenj.com letterhead.
Submit the whole packet to the VA Pension Management Center in Milwaukee by mail, by fax, or online through VA.gov. Walk-in filing is available at the VA Regional Office in Newark, 20 Washington Place. Our clients in Essex County and Union County often prefer a VA-accredited claims agent or VSO (free through the American Legion, VFW, or county Veterans Services) to review before submission.
The care plan 24HCNJ writes for the VA
The VA wants to see three things from the home care agency: that the care is medically necessary, that the hours and rate are reasonable, and that the ADLs match the ones the physician checked on Form 21-2680. We write a one-page care plan on 24 Hour Home Care NJ letterhead with Sofia Elmer, RN as the signatory. It lists the widow’s name, address, start date of service, scheduled weekly hours (for example, live-in Monday to Friday plus weekend relief), hourly or daily rate ($30 per hour companion, $420 to $550 live-in day in Union County, $720 to $1,080 rotation day), and the specific ADLs the CHHA performs.
According to 24 Hour Home Care NJ, the ADL list on our care plan must line up word for word with the ADL list the primary care physician checks on 21-2680. When the doctor checks bathing, dressing, and transferring, our plan says the CHHA assists with bathing, dressing, and transferring. Should the doctor add incontinence care, we add overnight incontinence care. Mismatched lists are the single most common reason a widow’s claim gets kicked back for more evidence.
We also attach a 90-day care log once service starts, so the family can submit it with any VA request for continued-eligibility review. Each log entry shows the CHHA’s name, shift start and end, and tasks completed that day. Her daughter in Morris County doesn’t have to assemble this herself; we send it monthly.
Timeline: six to twelve months, retroactive pay
Filing to approval runs six to twelve months at the Milwaukee Pension Management Center. Clean widow packets with VSO review land faster. Slower ones carry a questioned asset, a missing DD-214, or a 21-2680 that doesn’t match the care plan.
Here is the piece most families miss: approval is retroactive to the filing date. If a Chatham widow files October 14, 2026 and VA approves her claim on June 20, 2027, she receives a lump sum covering eight months at $1,478, or $11,824. Going forward she receives $1,478 by direct deposit on the first business day of each month. That lump-sum check covers the first-year gap between starting 24-hour home care and VA deciding yes.
For the official rate tables and the Milwaukee contact info, see the VA’s benefits portal at benefits.va.gov/pension/aid_attendance_housebound.asp.
Five mistakes that get a widow’s claim denied
| Mistake | What the VA sees | Fix before you file |
|---|---|---|
| Veteran served stateside only, dates outside war window | No wartime service, benefit denied | Check DD-214 dates against the four war windows |
| 21-2680 lists ADLs the care plan doesn’t | Evidence mismatch, request for more documents | Match physician ADL list to agency ADL list |
| Widow gifted $90,000 to daughter in 2024 | Three-year lookback penalty period applied | Disclose the transfer, calculate penalty, file anyway |
| Marriage certificate not certified | Benefit relationship unproven | Request certified copy from NJ county clerk |
| Hourly rate on care plan looks inflated | Reasonableness challenge, benefit reduced | Use 2026 Union or Bergen County standing rates |
FAQs
Can my mother use VA Aid and Attendance to pay for a live-in CHHA at home, or only for assisted living?
Yes, home care qualifies. The VA treats a live-in CHHA from a licensed New Jersey home care agency the same way it treats assisted living or a nursing home for unreimbursed medical expense math. Your mother’s $12,600 monthly live-in cost is deductible from her countable income. Call (908) 912-6342 and we’ll format the care plan the VA needs.
My father served in the Army from 1958 to 1961, between Korea and Vietnam. Does my mother qualify as a widow?
Unfortunately no. His service dates fall in a peacetime window between the Korea end-date (January 31, 1955) and the Vietnam start-date (February 28, 1961 or August 5, 1964 depending on in-country status). The wartime test is strict. If any portion of his 90-plus active-duty days touched a war window, we’d look again at the DD-214.
How long after my husband’s death can I still file for Aid and Attendance?
There is no deadline on filing. A widow can apply years after her husband’s passing, and the Milwaukee Pension Management Center processes the claim the same way as a recent-death filing. The benefit still pays retroactively to the filing date, not the date of death. We’ve helped Union County widows file 15 years post-funeral.
Will my mother lose Social Security if she gets approved for VA Aid and Attendance?
No. Social Security retirement and VA pension are separate programs with no offset. Her monthly check from VA ($1,478 at the 2026 maximum) stacks on top of her Social Security. VA pension does count as income for the asset-and-income math on future VA reviews, but Social Security itself is unaffected. Call (908) 912-6342 for the full stack math.
What’s the difference between Aid and Attendance and Housebound benefits?
Both are enhancements to the base VA pension. Aid and Attendance pays more and requires the widow to need regular aid with at least one ADL. Housebound pays less and only requires that she be substantially confined to her immediate premises. You can’t collect both at once. For home care cases we file for Aid and Attendance in roughly 95 percent of claims.
Ready to file for your mother?
We’ll write the care plan, format the ADL list to match 21-2680, and hand you a VSO contact in Newark. The call takes 20 minutes.
